Kiffen has some good comments. He also recognizes that the NCAA needs to implement some NFL style regulations.

The next step should be for the federal government to make a law so that all universities are playing by the same rules. Right now it varies from state to state. But now that they are getting paid legally, there's plenty of ways to hide booster pooling even if you outlawed it (boosters start a non-profit, or any type of business in general, and pay recruits through that company).
NIL varies from every other league in that these are essentially endorsement deals, in an effort to not make it "pay for play." Maybe paying them through the university would allow for better rules to be enforced?
I tend to agree. Let the individual universities pay the student athletes through program profits and NCAA/Conference profit sharing. Get rid of booster-funded NIL, and create a formal method of reimbursement through the schools. But then, like you said, that would just go back to the old days of the bag-man. Boosters will always figure out a way to funnel money to players to gain an advantage.
I don't know if this is a federal issue as long as all NIL payments are done lawfully. I see it as an internal NCAA issue. How can the NCAA create rules to ensure fairness and equality among all its member schools without violating an elite players ability to maximize his or her marketability?
I believe the future is formal contracts and free agents, portal windows, salary caps (on both players and coaches), freshmen limitations, and university-managed player payments. This wild-west stuff won't last long.
Kirby is not a fan of NIL and sees all the same pitfalls as some of us.

I think pharmacists shouldn't get paid. It really should be about the love of providing medicine for patients. We need more team and less me in the medical field. This is what yall sound like. Are things different and coaches will have to adapt? Yes. There also fringes cases that will likely need to be addressed, but that doesn't mean we go back to players not owning their identity
Future pharmacists (or doctors) aren't getting paid coming out of HS by boosters to go to a certain college. Every one of them MUST graduate college also, then a lot more school on top of that....no early entry into the employment pool. If some of them can make some extra cash on the side, that's great. But they aren't getting sums of money from boosters just for being there.
I think if you read the comments by Kirby, Saban, and Kiffen....they are all saying that NIL was not supposed to be a recruiting tool, and it certainly was not supposed to be boosters pooling money and just handing it out to players. You have to admit, getting a bag of money just for going to a certain school is not "owning their identity". It's a pay-for-play scheme. These kids are not hitting campus and then doing local car commercials or autograph signings.
yeah these fringe cases should be addressed. As far as it not being a recruiting tool I don't think we'll ever see that go away. Pretty much everyone wants to earn the most money they can. Could you imagine an employer trying to recruit new talent saying they don't think salary and bonuses should factor in to the decision to work for them? Insanity
That is true, and I agree. I think we are all in agreement that significant adjustments need to be made. The current format is not supportable long term.
Fair. And I happen to think when these kids fail to perform and show proper ROI most of the issues will solve themselves.
Or, kids make decisions based on NIL and go to a lesser school and fail to get the development and exposure they need. Travis Hunter and Kevin Coleman at JSU will be interesting to watch. I'm assuming they didn't go to an FCS team just because Sanders is such a great recruiter. Kirby touched on it when he was talking but selling kids on facilities, support and development....but a lot of kids are just looking at $$$ now. I have a feeling that a lot of these guys are going to regret taking the money instead of going to a school that can make them the best player they can be.
We learn by doing it wrong, not by doing it right. Many smart kids are paying attention to those guys at Jackson State the next couple of years.
I wasn't paid in school. In fact... I had to pay them. Quite a lot too.
No one wanted to buy your scrubs or come see you learn in class either I’m guessing.
